Plain-language terms for using ApplyMagik. The short version: be truthful in your applications, you approve everything we send, your data stays yours, and we're honest about what AI can and can't promise.

These Terms of Service ("Terms") are a binding agreement between you and ApplyMagik ("ApplyMagik", "we", "us") governing your use of the applymagik.com website, the app at app.applymagik.com, our APIs and MCP endpoints, and any related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
ApplyMagik is an AI career agent. It helps you build and tailor résumés and cover letters, scores your fit against job postings, fills out job application forms on your behalf ("Auto-Apply"), and tracks the results. Some features act on your explicit instruction and on your behalf — see §6.
You must be at least 16 years old and provide accurate account information. You're responsible for activity under your account and for keeping your credentials (including any API or MCP keys we issue you) secret. Tell us promptly at [email protected] if you suspect unauthorized access.
You agree to use the Service only for your own genuine job search (or, with our written permission, on behalf of someone who has authorized you). You must not:
When you use Auto-Apply, you authorize ApplyMagik to act as your agent to open the employer's application, fill it with information from your profile and tailored documents, and — only after you give final approval — submit it. By default nothing is submitted without your explicit approval of that submission ("pause-for-review"). If you enable any hands-off mode that submits without per-application review, you accept responsibility for those submissions as if you had approved each one.
Employer sites and applicant-tracking systems belong to third parties. Their availability, behavior, and terms are outside our control; a submission can fail, be rejected, or render differently than previewed. We make reasonable efforts to detect and report failures but can't guarantee any application is received or considered, and we never guarantee interviews, offers, or employment outcomes.
The Service uses large language models. AI-generated content — tailored bullets, cover letters, answers, match scores — can be inaccurate, incomplete, or otherwise imperfect. It is provided as a draft for your review; you are responsible for reviewing and approving content before it is used or submitted. Match scores and similar signals are estimates, not assessments by employers.
If you add your own AI provider key, calls made with it run through your provider account under that provider's terms, pricing, and data policies. We store the key encrypted, use it only to make calls you initiate, and you can remove it (or revoke it provider-side) at any time. You're responsible for charges your provider bills you.
Paid plans may include programmatic access to your ApplyMagik data and tools via API endpoints and a hosted MCP (Model Context Protocol) server, authenticated by keys we issue you. Your keys are personal: keep them secret, don't share them, and rotate them if exposed. Programmatic access is subject to your plan's rate limits and allowances, and to these Terms — anything an integration does with your key is treated as done by you. We may suspend keys involved in abuse, and we may version or evolve the API/MCP surface with reasonable notice for breaking changes.
Yours. Your résumés, profile, answers, and documents are yours. You grant us a limited license to host, process, and transmit them solely to operate the Service for you — including sending them to employers you direct us to apply to and to the AI provider powering your requests. We do not sell your content and do not use it to train models. You can export or delete your data as described in the Privacy Policy.
Ours. The Service — its software, design, and branding — is owned by ApplyMagik and its licensors. We grant you a personal, non-transferable license to use it under these Terms. Feedback you send us may be used without obligation.
You can close your account at any time in Settings. We may suspend or terminate accounts that materially breach these Terms (with notice where practical), or where required for legal or security reasons. On termination, your license ends; §§7, 10–14 survive. You'll have a reasonable window to export your data unless the law requires us to withhold it.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement; we do not warrant uninterrupted or error-free operation, or any employment outcome.
To the fullest extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, opportunities, or data; and (b) our total liability for all claims arising out of the Service is capped at the greater of the amounts you paid us in the 12 months before the claim or USD $100. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.
We're actively building — features may change, improve, or be retired. If we make material changes to these Terms we'll notify you (email or in-app) at least 14 days before they take effect; continued use after that constitutes acceptance. The "Last updated" date above always reflects the current version.
These Terms are governed by the laws of the United States and the state in which ApplyMagik is organized, without regard to conflict-of-law rules. Before filing any claim, contact us at [email protected] — most issues can be resolved quickly and informally. Nothing in these Terms limits rights you have under mandatory consumer-protection law where you live.
